Hello Everyone!

We know it’s been a while since we’ve actively updated this page, HOWEVER, we are excited to share some exciting news regarding the Buskerfest Miami movement! After taking some time to reflect (and research) following Buskerfest 2013, we discovered that, contrary to what we were told, there is nothing in the City of Miami code that specifically outlaws the practice of busking or street performance. As you might expect, there are ordinances restricting noise and the blocking of the public right-of-way, but as long as you abide by those rules, busking is an entirely legal act in Miami. Furthermore, public performance is a protected right under the First Amendment of the Constitution, so know your rights!

In an effort to be proactive, we are currently drafting a model ordinance with the help of some of our friends in the legal world. The goal is to formulate reasonable and responsible legislation that we can bring to the city commission to have busking and street performance properly recognized as a protected act in the city. But, we need your help! If you have suggestions on things to include or exclude in this model regulation, let us know. Maybe you come from another city that handles busking in a particularly effective way. Let us know! If you’re a busker performing in a public space and are stopped by the police, please document that experience here so we can highlight the need to enact appropriate legislation.
